This agreement is between "You", the user, and Bokenkamp Consulting, LLC, "Us" or "We". The agreement covers providing a website with an application interface and proprietary code, referred to as the "Service".

You may not modify, copy, distribute, transmit, display, or publish any materials contained on the Bokenkamp Consulting websites without the express prior written permission of Bokenkamp Consulting or the appropriate copyright owner. Certain names and logos are trademarks and service marks of Bokenkamp Consulting and may not be used without permission.

WE MAKE NO REPRESENTATION OR WARRANTY THAT ANY CONTENT IS ACCURATE, COMPLETE, APPROPRIATE, RELIABLE, OR TIMELY.   5. is sexually explicit;
  6. constitutes surveys, contests, chain letters or pyramid schemes; or
  7. contains viruses, Trojan horses, worms, time bombs, or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.

You further agree not to:

  1. use any false or inaccurate biographical information or other information for purposes of registering as a user of the Service, or for purposes of registering for any promotions offered through the Service;
  2. delete or revise any material or other information of any other user of the Service;
  3. harvest or otherwise collect information about others, including e-mail addresses, without their consent;
  4. take any action that imposes an unreasonable or disproportionately large load on the Service's infrastructure;
  5. use any device, software or routine to interfere or attempt to interfere with the proper working of the Service or any activity being conducted on this site;
  6. use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the Service other than the search engine and search agents available from Bokenkamp Consulting on the Service and other than generally available third party Web browsers (e.g., Netscape Navigator and Microsoft Internet Explorer); or
  7. allow any other person or entity to use your user ID or password for posting or viewing comments or sending or receiving materials;
  8. attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Service.

You further agree not to violate or attempt to violate the security of the Service, including, without limitation:

  1. accessing data not intended for you or logging into a server or account that you are not authorized to access;
  2. attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
  3. attempting to interfere with service to any user, host or network, including, without limitation, by way of submitting a virus to, or overloading, "flooding", "spamming", "mailbombing" or "crashing", the Service; or
  4. forging any TCP/IP packet header or any part of the header information in any e-mail or posting. Violations of system or network security may result in civil or criminal liability. Bokenkamp Consulting will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

4. Updates and Changes

Bokenkamp Consulting reserves the right to revise and update these terms and conditions at any time. Please periodically review the Terms of Use Agreement and Disclaimer. Your continued use of this site is deemed to be your acceptance of and agreement to any changed terms and conditions.

5. Warranty

Bokenkamp Consulting is providing the Health Panda Therapist Directory as a public service for those interested in working with mental health care providers (therapists, counselors, marriage and family therapists, social workers, psychologists, psychiatrists, nurse practitioners, etc.). Bokenkamp Consulting cannot and does not provide any warranties related to the information contained in or resulting services from the mental health care providers listed in the Therapist Directory. Information accessed through the Therapist Directory is provided "AS IS" and without any warranty, either expressed or implied, including, but not limited to, any implied warranty of merchantability or fitness.

Bokenkamp Consulting does not examine, determine, or warrant the competence of any mental health care provider listed in the Therapist Directory. Bokenkamp Consulting does not warrant that the mental health care providers listed in the Therapist Directory are currently or properly licensed. Under no circumstances should this Therapist Directory be used to verify the credentials of mental health care providers. Please contact your State Professional Licensing Board to verify the licensure of a provider. Use of this Therapist Directory to locate a mental health care provider is wholly voluntary and will not result in any liability against Bokenkamp Consulting. In no event shall Bokenkamp Consulting be liable for damages to any user of the Therapist Directory.

6. Verification Mark

The Verification mark, found on the profile page of some therapists listed in the Therapist Directory, indicates that a particular therapist has had their state license confirmed as active with their State Licensing Board. Verification is voluntary, meaning that a member without the Verification mark is not necessarily unlicensed.

Because of the potential for human error, please be aware that the Verification mark cannot serve as a guaranteed indication that a particular therapist listed in the Therapist Directory is currently or properly licensed. Thus, Bokenkamp does not warrant that the mental health care providers listed in this Therapist Directory are currently or properly licensed. Under no circumstances should this Therapist Directory be used to verify the credentials of mental health care providers. Please contact your State Professional Licensing Board to verify the licensure of a provider. Furthermore, Bokenkamp Consulting does not examine, determine, or warrant the comapetence of any mental health care provider listed in this Directory.

7. Substitute

Furthermore, this Therapist Directory is not intended to be a substitute for professional advice, diagnosis, medical treatment, or psychotherapy. Always seek the advice of your physician or other qualified mental health provider with any questions you may have regarding any mental health symptom or medical condition. Never disregard professional psychological or medical advice nor delay in seeking professional advice or treatment because of something you have read on our website.

8. Posting Information

You agree not to post any information which (a) is libelous, defamatory, obscene, fraudulent, false, unlawful, or contrary to the ownership or intellectual property rights of any other person, or (b) contains any virus, worm, or other code which is contaminating or destructive to the files or programs of Bokenkamp Consulting or any of our users. Bokenkamp Consulting may deny you access to all or part of any Bokenkamp Consulting website if Bokenkamp Consulting, in its sole discretion, determines that you have engaged in conduct that violates the law or the terms of this agreement.

9. Governing Law; Jurisdiction; Statute of Limitations

This agreement shall be governed by the laws of the Commonwealth of Pennsylvania applicable to agreements wholly made and performed in Pennsylvania without regard to its conflict of laws principle. Any legal action, suit or proceeding arising out of or relating to this agreement or a breach thereof, shall be instituted in a court of competent jurisdiction in Philadelphia County, Pennsylvania, and you hereby consent and submit to personal jurisdiction of such court, waive any objection to venue in such court and consent to service of process by overnight courier or express mail at your last known address. Any cause of action initiated by you must be initiated within one (1) year after the claim or cause of action has arisen or it will be barred.

If any clause or provision of this agreement is determined to be illegal, invalid or unenforceable under present or future law, then, in that event, such clause or provision will be severed from this agreement without affecting the enforceability of all remaining clauses and provisions.
